Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the TekSpert StreamOverlay desktop application, website and related services (together, the “Service”). The Service is provided by TekSpert Ltd, a company registered in England and Wales (Company No. 16711813) (“TekSpert”, “we”, “us”).

By creating an account, subscribing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

TekSpert StreamOverlay is a desktop application that plays event-driven screen overlays for live streaming. It reacts to your live events — such as gifts, follows, likes, comments, subscriptions, gifted subs, bits, Kicks and Super Chats — by displaying animations, alerts and custom content on your chosen display and in OBS. We may add, change or remove features from time to time.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.

Access to the Service requires a paid subscription. Payments are processed by our payment provider, Stripe. By subscribing, you authorise us and Stripe to charge your chosen payment method for the applicable fees.

• Subscriptions renew automatically at the end of each billing period until cancelled.
• You can cancel at any time from your dashboard; access continues until the end of the current paid period.
• Fees are stated in pounds sterling (GBP) and may be exclusive of applicable taxes.
• We may change our fees on reasonable notice, which will apply from your next billing period.

Except where required by law, payments are non-refundable. Nothing in these Terms affects your statutory rights as a consumer.

When you hold an active subscription, we issue you an activation key. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own streaming activities.

• Each activation key binds to a single device and must not be shared or resold.
• The application validates your key and subscription status periodically while running.
• If your subscription lapses, your key may be suspended until billing is restored.
• We may revoke a key for breach of these Terms.

You may connect your own accounts on third-party streaming platforms — including TikTok, Twitch, YouTube and Kick — so the Service can receive your live events and play your overlays. You authorise each connection yourself and may disconnect it at any time.

• Your use of each platform is governed by that platform’s own terms, and you are responsible for complying with them.
• You must only connect accounts you own or are authorised to use, and only use the Service in ways those platforms permit.
• We access and use your platform data solely to provide the overlay features you configure, as described in our Privacy Policy.
• The platforms may change or withdraw their APIs at any time; we are not responsible for the availability of, or changes to, third-party platforms.

When you connect YouTube, you also agree to the YouTube Terms of Service. Your use of the other platforms is subject to their terms: TikTok, Twitch and Kick. TekSpert is an independent tool and is not affiliated with, endorsed by, or sponsored by TikTok, Twitch (Amazon), YouTube (Google) or Kick.

You agree not to, and not to permit others to:

• copy, modify, reverse engineer or create derivative works of the Service, except as permitted by law;
• circumvent activation, licensing or usage limits;
• use the Service unlawfully, or to display content that is unlawful, infringing or harmful;
• use the Service in any way that breaches the terms of a connected streaming platform;
• resell, sublicense or otherwise make the Service available to third parties.

The Service, including its software, design and branding, is owned by TekSpert or its licensors and is protected by intellectual property laws. You retain ownership of the custom content you create; you are responsible for ensuring you have the rights to use any content you display through the Service.

We aim to keep the Service available but do not guarantee uninterrupted operation. We may update, suspend or discontinue parts of the Service, and may release updates that install automatically to keep the application secure and current.

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Subject to the above, we are not liable for indirect or consequential loss, loss of profits, revenue, data or goodwill, and our total liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the Service ends and your activation key may be deactivated.

We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protection rules that apply where you live.
